Terms of use

PickMyLink Inc. (hereinafter PickMyLink), operates the platform at https://pickmylink.com and provides Creators with the opportunity to monetize content through affiliate programs. By using PickMyLink, you agree to unconditionally comply with these Terms of Use (hereinafter the “Terms”).

The participants of PickMyLink are Brands, Creators, and PickMyLink.

• Brands are entities that define Affiliate Program terms and allow promotion of their goods/services via monetized referral links.
• Creators are individuals or entities who share these links through their social media, websites, or digital channels.
• PickMyLink is the online platform at https://pickmylink.com, enabling Creators to easily convert any valid product link into a monetized affiliate link.

1. General Provisions

   1. To use PickMyLink, Creators must register an account providing an email address, password, and at least one active social media or content channel.
   2. By registering, you agree to these Terms and confirm your participation in PickMyLink’s network.
   3. You agree to maintain only one Creator account.
   4. You must be 18 years or older to register.
   5. These Terms form the binding agreement between PickMyLink and the Creator, governing the use of services at https://pickmylink.com and related tools.
   6. Use of PickMyLink is free of charge. Participation is voluntary, and you are not obligated to maintain activity if you choose to leave.
   7. Participation does not establish a direct legal contract between the Creator and individual Brands unless explicitly stated.

2. Service Scope

   1. Creators may share monetized referral links only through their verified and declared social media or websites. When users click through and complete a “Target Action” (purchase, registration, etc.), the Creator becomes eligible for a reward.
   2. PickMyLink tracks and logs all actions and provides visibility into performance metrics. However, the final approval of any Target Action is made by the Brand or affiliate network, and PickMyLink does not influence these decisions.
   3. PickMyLink is committed to continuous platform improvement and may temporarily suspend services for maintenance or upgrades.
   4. You acknowledge that technical requirements (internet access, third-party services, device compatibility) are your responsibility. PickMyLink is not liable for disruptions caused by external factors.
   5. PickMyLink reserves the right to withhold payments in case of suspected violations or to verify your identity and traffic sources.

3. Participation Requirements

   1. Only accounts (social media, websites, or content channels) that comply with applicable laws and these Terms may participate. PickMyLink reserves the right to approve or reject Creators at its sole discretion.
   2. You must provide accurate and up-to-date information. Any changes to your account (email, social media handles, payment details) must be updated within 5 days.
   3. You are responsible for safeguarding your account credentials and must not share them with others. You bear full responsibility for any activity under your account.
   4. You must have the legal right to promote content via your social media or website and ensure your activity complies with local laws.
   5. When posting referral links, you must not infringe any third-party trademarks, intellectual property, or personal rights. Any violations are solely your responsibility.
   6. You must not engage in activities that disrupt the operation of PickMyLink, such as hacking, introducing malware, spamming, or attempting unauthorized access.
   7. You are responsible for keeping referral links updated. Broken links (due to brand program pauses, social media deletions, or expired deeplinks) may result in non-payment.
   8. You are solely responsible for complying with all applicable laws, including local advertising and privacy regulations.

4. Transparency and Verification

   1. PickMyLink may request information to verify your traffic sources, social media accounts, and campaign performance. You agree to provide any required data within 7 days.
   2. PickMyLink may also request personal documentation to verify your identity (e.g., legal name, address, tax details). Refusal to provide verification may result in account suspension or termination.

5. Prohibited Practices

   1. You must not:
      • Generate fraudulent or fake Target Actions (including self-clicking, bots, or artificial traffic).
      • Use deceptive advertising methods (e.g., misleading links, false claims).
      • Infringe on brand trademarks, use cookie stuffing, or bid on branded terms in search engines without explicit permission.
      • Place referral links on illegal, offensive, or prohibited content (e.g., hate speech, violence, adult content).
      • Promote via banned traffic sources such as coupon sites, cashback services, or unauthorized ad arbitrage unless explicitly allowed.
      Violations may lead to immediate account termination and forfeiture of earnings.

6. Payments

   1. Your reward is based on the success of your campaigns (CPA or CPC), as tracked and confirmed by the affiliate networks and Brands.
   2. The applicable rate is determined by the Brand at the moment of the Target Action. Changes in rates do not apply retroactively to past actions.
   3. The minimum withdrawal threshold is €20. Any balance below this will only be paid if your account is closed.
   4. You are responsible for ensuring that your payment details are correct and up to date. PickMyLink is not responsible for payment delays due to incorrect information.
   5. Taxes and fees: You are solely responsible for your own tax reporting and compliance. PickMyLink may deduct applicable withholding taxes if required by law.
   6. Any overpayments or payments made in error must be returned to PickMyLink promptly.

7. Termination

   1. These Terms are valid indefinitely from the date of your registration.
   2. Either party (you or PickMyLink) may terminate this agreement at any time.
   3. PickMyLink reserves the right to delete inactive accounts after 350 days of no activity, with prior notice. After deletion, any remaining funds below the withdrawal threshold will be forfeited.
   4. If you violate these Terms, PickMyLink may suspend or terminate your account immediately, and any unpaid earnings may be withheld.

8. Confidentiality

   1. Both parties agree to maintain confidentiality regarding proprietary information shared during the course of participation, except as required by law.
   2. Confidentiality obligations remain in effect for 5 years after account termination.

9. Personal Data Protection

   1. PickMyLink processes only data you provide upon registration and during participation.
   2. You must comply with local privacy laws (e.g., GDPR) regarding your own content and disclosures.

10. Liability

    1. PickMyLink is not liable for:
       • Service interruptions or downtimes.
       • Loss of earnings due to advertiser/network rejections.
       • Damages arising from misuse of the service.
       Creators are fully responsible for their promotional activities and any legal consequences thereof.

11. Amendments

    1. PickMyLink reserves the right to update these Terms. You will be notified of changes, and continued use after updates indicates your acceptance.

12. Governing Law

    1. These Terms are governed by Luxembourg law.
    2. Disputes shall be subject to the exclusive jurisdiction of the courts of Luxembourg.
